SoftClinic GenX is a product of JVS Technologies Private Limited, a company governed under the provisions of the Companies Act, 2013 having its registered office at [A-401, Ganesh Plaza, Navrangpura, Ahmedabad – 380009 Gujarat INDIA ] (“JVS”) .

SoftClinic GenX is an user-friendly HealthTech technology solution, which helps healthcare providers to assist them provide their services to their patients.

This policy (“Policy”) describes how SoftClinic GenX handles the information and data you provide to us, how SoftClinic GenX collects, uses and / or shares the same. SoftClinic GenX shall make every endeavour to protect your information as per practices consistent with applicable law.

The personal identifiable data (PHI) data that you upload on SoftClinic GenX is private and visible to you and your users only. SoftClinic GenX does not allow any other user to view such data.

Your use of SoftClinic GenX and services offered by JVS will involve you in uploading and / or inputting various contents into SoftClinic GenX which may largely include but not limited to personal identifiable data (PHI) of the users or their customers, medical records, billing information, appointment details, prescription data, insurance information, and other related data 2 and any other details of yours or your customers’ you may have and you wish to upload for the purpose of using the services of SoftClinic GenX, etc. (the “Content“).

SoftClinic GenX assumes that all the Content uploaded / inputted by you onto SoftClinic GenX shall be legally obtained and that you have all the rights to upload / input the same onto SoftClinic GenX.

SoftClinic GenX shall not be responsible for any claims of whatsoever nature in relation to the uploading / inputting the Content and using the same as per the terms of the Policy and / or as per the standard terms and conditions for use of SoftClinic GenX (“Terms for Use”).

SoftClinic GenX shall use the Content for the following purpose3 :

1. To provide you services:
   SoftClinic GenX shall use the Content for enable you to connect with your customers by using SoftClinic GenX. All the services that may be provided by SoftClinic GenX shall use the Content.
2. To improve customer service:
   The Content helps SoftClinic GenX to respond to the customer service more efficiently. SoftClinic GenX shall therefore be using the Contents for providing the customer service requests and support needs.
3. To send periodic communication:
   SoftClinic GenX may use the Content to ask for feedback and / or inform you of product news and opportunities. In any such communication, SoftClinic GenX will always provide a method to opt out of future communications.
4. To personalize your experience:
   The Content helps SoftClinic GenX to better respond to your individual needs and therefore SoftClinic GenX may use the Content in responding to your needs.
5. To maintain, protect and / or improve our services and develop new ones:
   SoftClinic GenX may also use the Content to maintain, protect and / or improve upon its services as also to develop new services on the basis of the Content.

In addition to the above, it is possible that SoftClinic GenX may need to disclose the Content and / or information about your activities as an user when required by law, subpoena, or other legal process, whether in the Indian or other jurisdictions, or if we have a good faith belief that disclosure is reasonably necessary to

1. Investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies;
2. enforce the terms and conditions of the Terms of Use (or any other agreements entered into by you with SoftClinic GenX), investigate and defend SoftClinic GenX against any third-party claims or allegations, or protect the security or integrity of SoftClinic GenX’s services; and / or
3. exercise or protect the rights, property, or safety of SoftClinic GenX, its members, users, personnel, or others. SoftClinic GenX may attempt to notify you about legal demands for their personal information when appropriate in SoftClinic GenX’s judgment, unless prohibited by law or court order or when the request is an emergency.

In light of SoftClinic GenX’s principles, SoftClinic GenX may dispute such demands when SoftClinic GenX believe, in SoftClinic GenX’s discretion, that the requests are overboard, vague or lack proper authority, but do not commit to challenge every demand.

SoftClinic GenX needs your permission to do things like hosting the Content, creating back-ups for it and sharing it when so required by you. SoftClinic GenX’s services also provide you with features various features. These features may require SoftClinic GenX’s systems to access, hospital, clinics and scan the Content. Where you give SoftClinic GenX permission to do such actions, your permission is also deemed to be given to SoftClinic GenX’s affiliates, if any, and trusted third parties SoftClinic GenX engage with.4

SoftClinic GenX may also collect your personal information such as your name, your hospital / clinic’s name, email address, your user name, password,  at the time that you register for an account on the Service or thereafter. If you wish, you may also provide us with optional information such as a photograph, skills, addresses, educational background, analytics graphs, etc. of your hospital, services, business, etc. Your such details and any optional profile information that you may elect to associate with your account is referred to in this Policy as your “Profile Information.” The Profile Information is or may be used to send you service-related notices (including any notices required by law).

SoftClinic GenX may also use your email address to send you notifications and information about other products or services (including third party services) that SoftClinic GenX think may be of interest to you (“Marketing Messages“). You may opt-out of receiving Marketing Messages at any time by following the instructions provided in the Marketing Message. Through your account interface, you may also opt-out of receiving categories of Service-related notices that are not deemed by SoftClinic GenX to be integral to your use of the service.5

For payments required to be made by you, SoftClinic GenX utilizes a third party credit card payment processing company which collects payment information, including your credit card number, billing address and / or phone number. SoftClinic GenX will share this payment information with the third party processing company.

SoftClinic GenX may use the services of certain trusted third party service providers for hosting the service or processing payments of paid members. Such service providers may have access to your information; however they can use your information only for the limited purpose of providing the service SoftClinic GenX have contracted with them to provide. SoftClinic GenX shall try to see to it that such service providers also have a data security and privacy policy that are at least as protective of your information as is in this Policy. SoftClinic GenX may also store your Personal Information in locations outside the direct supervision of SoftClinic GenX (for instance, on servers or databases co-located with hosting providers).

When you use the service, SoftClinic GenX’s servers begin to automatically record certain information in their server logs. These server logs may include information such as your web request, Internet Protocol (i.e. IP) address, browser type, referring / exit pages, your phone number, type of  and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, mobile carrier, date, time, and duration of your visit, information about the computer set-up such as the type and version of web browser, operating system, Java support, Flash version, screen resolution, and connection speed and other such information.

Your use of SoftClinic GenX services may generate “cookies”. SoftClinic GenX may use such “cookies” to collect information and observe and improve its services or to increase its functionality and user-friendliness. SoftClinic GenX may use “persistent cookies” to save your session ID for future logins to the service such as for the purpose of remembering your user name when you return to the service as also to help SoftClinic GenX to understand how you interact with / use the SoftClinic GenX service, etc.

SoftClinic GenX will retain the Content for as long as your account is active or as needed by us to provide you the services. If you wish to cancel your account or request that SoftClinic GenX, you may delete your account. However, the Content stored in SoftClinic GenX servers and back-ups may still continue to remain on server of SoftClinic GenX.

SoftClinic GenX may collect and process information about the location of the device from which you are using the service. Location information may help SoftClinic GenX to understand how you access and / or use the service and may be used along with personally identifiable information. We may share these information as also the Personal Information to connect with you with a third party. We may disclose aggregated demographic information (such as aggregate and anonymous usage data, platform types, etc.) about the overall use of SoftClinic GenX service publicly or with users, or other organizations with which we do, or contemplate doing, business to help them understand the service, or to help us improve and analyse the service.

If SoftClinic GenX is involved in a merger, acquisition, and / or sale of all or a portion of its assets, your information may be transferred as part of that transaction. Any third party to which SoftClinic GenX transfer or sell its assets shall be entitled to continue to use your Personal Information and other information collected by SoftClinic GenX under this Policy.
This Policy may be changed by SoftClinic GenX from time to time. If SoftClinic GenX make a change to this Policy that SoftClinic GenX believe adversely reduces your rights, SoftClinic GenX will provide you with notice of such changes on your email. SoftClinic GenX may provide notice of changes in other circumstances as well. By continuing to use the service after those changes have become effective, you agree to be bound by the revised Policy.

Your Profile Information and Content are yours and SoftClinic GenX do not own or use it, except for situations required for providing you with the services in an efficient manner and as is set out in this Policy. Where SoftClinic GenX or it’s agents collect non-public personal information from you, reasonable steps will usually be taken to protect such information in transmission. However, there may be situations when such information cannot be completely protected. Please note that unless the connection is specifically indicated as being secure by SoftClinic GenX or by SoftClinic GenX’s agents, or you are otherwise informed of the security of your information, you should assume that the connection is not secure and that it is possible for outside parties to unauthorizedly intercept the information shared by you and SoftClinic GenX during that part of the session.

We reserve the right to revise and update this policy periodically, and the most current version will be posted on our website. If you continue to use our software, you are agreeing to the revised policy. However, if you do not agree with the updated terms of this privacy policy, we request that you refrain from entering any data into the software.
